The subject property is located within the I, Industrial zoning district, which permits: manufacturing, processing, or assembly of goods; warehouses; storage or wholesaling within the principal building; offices and financial uses; and others.  Based on review of the yard and bulk requirements, it appears that the subject is in legal non-conformance with respect to zoning requirements.  Supportive parking is located within a parcel on the opposite side of Day Street and not on-site as required within zoning requirements.  The subject predates current zoning requirements and changes are not necessary.

Site Description

The property consists of land on both sides of Day Street at the intersection with Francis Avenue.  A reproduction of the survey map referenced in the most current deed is included within the Addenda as Exhibit E.  The site contains land area of approximately 5.21 acres, or 227,148 square feet.  The property is provided with noncontinuous footage along Day Street and Francis Avenue.  The site is level at improvements and slopes down towards a small brook, which is located along the western perimeter of 240 Day Street.  There is no excess land at the subject due to topography and brook at the site, as well as parking requirements.  There are approximately 126 parking spaces provided with the majority (104) located across the street.  Site improvements include sanitary sewers, electricity and telephone service, public water, natural gas, and similar improvements.  The subject property is located in Zone C, areas of minimal flooding and Zone A4, areas of 100-year flood on Flood Insurance Rate Map Community Panel No. 090033 0005 B, dated October 16,1979

Building Description

The subject was constructed in 1953 with an addition constructed in 1982.  The gross building area is 54,087 square feet,  including 3,441square feet of basement space.  The exterior of the subject building is masonry and metal with block, brick, metal and some vinyl exterior.  The roof is flat and consists of a wood frame on the original building and steel on the addition.  The entire building is provided with a sprinkler system.  

The office is located at the south end of the building and comprises a total of 7,812 square feet of the total gross building area (14%).  This figure includes the basement of 3,441 square feet.  The subject office is two stories over basement with adequate lavatories.  Finishes include: wall -to-wall carpet or tile flooring, paneled walls, suspended fluorescent lighting and metal windows. 

The manufacturing space is finished with concrete slab flooring, steel columns, block or metal walls, and suspended strip fluorescent lighting.  The space includes a paint room and spray booth.  Exterior wall heights approximate 12 feet  on the original building and 16 feet on the addition.  Clear heights range from 8 to 10 feet and are mainly limited by hanging lights.  The addition could obtain a greater clear height after raising lights by several feet.  This space is provided with two drive-up dock height doors (10 and 12 feet) and two drive-in doors.  The 12-foot dock is provided with a crane.

A central oil fired boiler system (three furnaces) and wall mounted radiator service provides heat to the building.  The office is also provided with a central air-conditioning system, which is ducted.
